Terms and conditions

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY.

SAFETY

You are responsible for the safety of your family and guests and you will ensure that they are all aware of the safety provisions contained in this agreement, and on any safety card that might accompany the spa.
If you or anyone else entering the spa has health problems or are pregnant, they must obtain a doctor’s clearance BEFORE entering the spa.
Children MUST be supervised at all times whilst in or around the spa.
When the spa is not in use, the cover must remain on and locked for safety purposes, the spa must remain plugged in for filtration and heating purposes, and the main jets turned off.
No Animals are allowed in the spa at any time.
There is to be no alcohol, drugs or cigarettes consumed at any time whilst in the spa.
There is to be no jumping, bombing, gymnastics, heavy petting etc. whilst in the spa.
The spa is NOT to be used in an electrical storm and hirer is only to use extension cord provided.
Do not use any electrical items (including mobile phones) within 2 metres of the spa.
You must keep the spa clean and hygienic, using only the chemicals supplied by us, in the proportions referred to in the Instructions for Use. The spa must only be filled with town or tank water. It must not be filled or topped up with river, bore (spear-pump) recycled or any other water.
The spa is not to be overloaded with people or used contrary to common sense and design limitations. Please only use the moulded seats provided.

OWNERSHIP, SECURITY, DAMAGE

You are totally responsible for the spa and will keep it secure from malicious damage, theft and any other detriment whilst it is in your possession.
If the spa is stolen or damaged you must phone us immediately, and the Police as well in the case of theft or malicious damage.
If the spa breaks down or does not work to your satisfaction you must not attempt to fix it but must call us straight away.
You will ensure that the spa is free from rubbish and is in an undamaged condition at the time of its return to us. You will be charged for any repair or replacement of damaged equipment including re‑certification, ancillary costs such as freight, and hire until the equipment is in a fit state to be hired out again.
Your hire charge includes normal cleaning. However you will be charged for cleaning that is required because of rubbish, foreign liquids in the water and other abnormal use.
We are deemed to own the equipment at all times, whether we own it outright or have acquired it through some other arrangement.
We may inspect the equipment at any time, or repossess the equipment at any time without giving notice or a reason. You authorise us to enter onto your property or wherever we reasonably believe the equipment to be, without being liable for trespass.

PAYMENT

Payment for the hired equipment will be made before the commencement of the hire as stated in the Schedule and any additional day or part thereof will be charged at the daily rate shown in the Schedule.
You will reimburse us for any costs incurred by us in connection with the termination of this agreement including but not limited to legal fees on an indemnity basis, debt collection fees, repossession charges and the like.

LEGAL

You agree to release us from any and all liabilities incurred as a result of the use of the spa & trailer.
We will not be held accountable for any fines incurred in relation to water usage, breaches of pool fencing regulations and any other legislation that you are expected to observe, whether issued by the local Council or any other Authority, and you will keep us indemnified if we are prosecuted as a result of your breach.
Our liability for breach of any implied condition or warranty (statutory or otherwise) is excluded, or to the extent that it cannot be excluded is limited to the repair or replacement of the hired equipment.
If any of these terms or conditions is unenforceable they will not invalidate the whole agreement, but will be deemed to be removed.
You will at all times ensure that you have adequate public liability insurance in place over the premises where the spa is to be used which will cover any equipment (including the spa) used in that place.

Disclaimer & Indemnity

I understand and acknowledge that the use of the spa and trailer is at my risk and I agree that GOLD COAST SPA HIRE will not be liable for any damage (including financial loss) claimed by any person as a result of anything to do with the hire of the spa including the breakdown of the equipment, delay in delivery, unavailability and the like and that I will keep GOLD COAST SPA HIRE indemnified against such claims.
I also agree to indemnify GOLD COAST SPA HIRE, its servants and agents from any loss that they might suffer as a result of the hire of the spa or a breach by myself, or any of my family and guests of any of the terms and conditions, including but not limited to reimbursing GOLD COAST SPA HIRE, its servants or agents for any money awarded against them arising from any person's claim for damages for death or personal or other injury arising from the use of the spa, trailer or equipment.
